HOW TO COMPLY WITH THE WKKGZ AS AN INDEPENDENT HEALTHCARE PROVIDER IN THE MEDICAL INDUSTRY?
If you are an independent healthcare provider active in medical care, then you fall under the Wkkgz (Quality, Complaints and Disputes Act). All healthcare providers in the Netherlands have been required to comply with this law since Jan. 1, 2017.
THE CHAIR
The Wkkgz stems from a development initiated to improve quality in healthcare. The main premise of the law is that the client receives good care. The law applies not only to the medical industry, but also to the cosmetic, mental and alternative care. The main reason is that mental or physical harm can also be caused to clients outside the direct care sector.
INCREASE IN SELF-EMPLOYED WORKERS
In recent years there has been a huge increase in the number of caregivers working as self-employed workers. For example, on a self-employed basis for home care organizations and mediation agencies, among others. Since 2017, the law applies not only to these large agencies but also to independent healthcare professionals working as district nurses, caregivers or in home care.
WHICH PROFESSIONS ARE COVERED BY THE WKKGZ?
There is still some doubt in which cases the law applies. The medical industry has a huge number of professions. An easy rule of thumb for legislation and to check if you fall under the law is:
Is your treatment designed to improve your clients' physical or mental condition?
If so, then you must comply with the Wkkgz and are required to have at least an external complaints procedure.

THE OBLIGATIONS OF THE WKKGZ
The Wkkgz is not a law you can insure yourself for.You must comply with the requirements. If you do not, you run the risk of a fine. If your profession is subject to the Wkkgz, you must comply with various obligations:
